When faced with a DUI charge, it's important to have an experienced lawyer on your side. Because you are faced with the possibility of going to jail or prison, you should hire an attorney, unless you qualify for the free or reduced-fee services of a public defender or court-appointed attorney. In Georgia, if you are indigent (Federal poverty guidelines), and the prosecutor is seeking jail time, the court may appoint an attorney. You must first complete a sworn affidavit listing your assets and income. Most public defenders or court-appointed attorneys carry a higher case load than other attorneys. It is not unusual for a PD to have 100 or more pending felony cases and a time, or for a court-appointed attorney to have 200 or more pending misdemeanors. With such a "volume" of practice, you will get what the constitution requires, but no more.
The truth is, no matter your intelligence or educational background, the criminal justice system makes it virtually impossible to do a competent job of representing oneself. Each case is unique, and only a specialist who is experienced in assessing the particulars of a case -- and in dealing with the many variables present in a DUI case -- can provide the type of representation that you need to receive if justice is to be done. There is never a requirement that you hire an attorney to represent you. You have the right to counsel, but you can give up that right. There are certainly less-expensive attorneys everywhere, and you may not need the experience I offer. What do you have to lose? |
