There is a new trend in drunk driving law: "no refusal" policies. No refusal means if a driver who is stopped for suspected drunken driving refuses to take a breath test, a judge issues an immediate warrant for a blood test. If the tests come back at the magic number of 0.08% BAC or above, the driver is immediately charged with drunk driving. No refusal is being considered in 9 states so far, despite the fact that penalties already exist for refusing a breath test in most, if not all, states. In Georgia, citizens refusing a breath test face an automatic license suspension with no work permit.

This policy is yet another that chips away at our precious civil rights. It is your right to refuse roadside sobriety tests. They are completely subjective and only lead to breathalyzer offers. It is your right to refuse a breath test. As you can read elsewhere in my blog and in other blogs devoted to this online, breath tests are notoriously inaccurate. Calibration remains suspect in many machines and there is no real scientific duplication. If "no refusal" policies become law, we have only ourselves to blame. Vote for people who take your rights seriously.
