Summer 2011: Out-of-stater gets minimum not max Case details: This was a high BAC case with an out-of-state license that began in a Municipal Court (to remain unnamed). The municipal court wanted the maximum fine of $1,000, 80 hours of community service plus probation and 10 days in jail. We sent the case to State Court and while we had to resolve with a DUI conviction, the judge imposed the mandatory minimum sentence: $300, 1 day in jail, 40 hours of community service, DUI School and alcohol evaluation.
